By accessing or using Arvad.ai, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.
You must be at least 18 years old and have the legal capacity to enter into binding agreements to use Arvad.ai. If you use our platform to build applications with age-restricted content or features, you must be of legal age to access such content in your jurisdiction and you agree that you meet this requirement. Additionally, you are responsible for implementing appropriate age verification, parental controls, and compliance with applicable laws governing age-restricted content and services for end-users. By using our platform, you represent and warrant that you meet all these requirements.
We reserve the right to modify these terms at any time. Material changes will be communicated via email and posted on our platform at least 30 days before taking effect. Your continued use of Arvad.ai after the effective date constitutes acceptance of the updated terms.
To use certain features of Arvad.ai, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these terms, fraudulent activity, or extended periods of inactivity.
You retain all rights to the project specifications, requirements, and ideas you provide to Arvad.ai. The code generated by our platform is provided to you with full ownership rights, and you may use, modify, and distribute it as you see fit.
Arvad.ai and its original content (excluding user-generated code), features, and functionality are owned by Arvad.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use Arvad.ai for your personal or commercial projects, subject to these terms and your subscription plan.
We may use anonymized and aggregated usage data, error logs, and performance metrics to improve our platform and AI models. We do not use your proprietary source code, project specifications, or confidential information for model training. You retain all rights to your inputs and generated outputs. We implement safeguards to detect and prevent data leakage between users.
Arvad.ai offers various subscription plans with different features and usage limits. You agree to pay all fees associated with your chosen plan according to the pricing and payment terms in effect at the time the fee becomes payable.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan, which may change with notice.
We offer a 14-day money-back guarantee for first-time subscribers. Refunds are processed within 10 business days of approval. Usage-based fees for deployments and cloud resources are non-refundable.
You agree to provide current, complete, and accurate billing information. You authorize us to charge your payment method for all fees incurred under your account.
You may not use Arvad.ai to violate any applicable laws or regulations, infringe intellectual property rights, acquire or exchange illegal substances, engage in human trafficking, or facilitate any illegal activity in your jurisdiction.
You may not use our platform to compromise computer systems, networks, or critical infrastructure; develop malware, ransomware, or exploits; conduct unauthorized penetration testing; create tools for denial-of-service attacks; or bypass security controls without proper authorization.
You may not use Arvad.ai to create content that incites violence, promotes terrorism or hate speech, facilitates child exploitation, depicts graphic violence or animal cruelty, promotes self-harm or suicide, or engages in harassment, bullying, or intimidation of individuals or groups.
You may not use our platform to create or spread misinformation, engage in fraudulent schemes, generate fake reviews or synthetic media to deceive, impersonate individuals without consent, create counterfeit documents, facilitate phishing or scams, or plagiarize content without proper attribution.
You may not use Arvad.ai to violate privacy rights, collect personal data without consent, engage in unauthorized surveillance, manipulate democratic or electoral processes, create deceptive political content, suppress voter participation, or facilitate unlawful censorship on behalf of government entities.
You agree to use platform resources reasonably. Do not engage in activities that impair platform performance, create multiple accounts to circumvent restrictions, use automation for spam, intentionally bypass safety guardrails without authorization, or scrape our models to train competing AI systems.
For use cases in healthcare, legal services, financial advice, employment decisions, insurance underwriting, academic testing, or professional journalism, you must: (1) have qualified professionals review AI-generated outputs before use, and (2) disclose to end-users that AI was involved in generating advice, decisions, or recommendations.
If you create consumer-facing applications or chatbots using Arvad.ai, you must disclose to users that they are interacting with AI-generated content or AI systems, not exclusively with humans. This disclosure must be clear and provided at the beginning of each interaction session.
When using AI-generated code or content from Arvad.ai in commercial products, public repositories, or professional contexts, you should provide appropriate attribution indicating that portions were generated with AI assistance, where transparency is material to end-users or stakeholders.
You are solely responsible for reviewing, testing, validating, and determining the appropriateness of all AI-generated code and content before deployment or distribution. The accuracy, security, legal compliance, and ethical implications of AI-generated outputs are your responsibility.
While we strive for 99.9% uptime, Arvad.ai is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the service will be uninterrupted, secure, or error-free.
While our AI generates production-ready code, we do not guarantee that generated code will be bug-free or meet all your specific requirements. You are responsible for testing and validating all generated code before deployment.
We integrate with third-party services (cloud providers, APIs, etc.). We are not responsible for the availability, functionality, or security of these third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Arvad.ai implements automated monitoring and detection systems to enforce this Terms of Service and our Acceptable Use Policy. If we detect violations, we may throttle, suspend, or terminate your access to our platform. We may also block or modify outputs when inputs violate our policies.
If you believe our AI has generated inaccurate, biased, harmful, or inappropriate content, please report it immediately to safety@arvad.ai. You can also use the feedback features within our platform to flag problematic outputs.
We are committed to responsible AI development and will investigate all reports promptly. In cases involving child exploitation, we will report to relevant law enforcement authorities as required by law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARVAD.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE; OR (D) ANY CONTENT OBTAINED FROM THE SERVICE.
Our total liability for all claims arising out of or relating to these terms or the service shall not exceed the amount you paid to Arvad.ai in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Arvad.ai and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the service; (b) your violation of these terms; (c) your violation of any third-party rights; or (d) any code or applications you generate using our platform.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law provisions.
Any disputes arising from these terms or your use of Arvad.ai shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for intellectual property disputes.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
